Vaudreuil-Dorion, Hudson, Saint-Lazare and the Île-Perrot towns are just west of the island. I come to families there to prepare the psychosocial assessment that the court needs for a protection mandate homologation or a tutorship. This page explains what is different about these files off the island.
Good to know: your file is not in the Montreal district
Many families assume everything goes through Montreal. It usually does not. Vaudreuil-Dorion, Hudson, Saint-Lazare, L'Île-Perrot, Notre-Dame-de-l'Île-Perrot and Pincourt are in the judicial district of Beauharnois. Its courthouse is in Salaberry-de-Valleyfield.
The application is usually filed in the district where your loved one lives. When someone is staying in a hospital or residence, other districts may be possible. Your notary will confirm.
In practice, this rarely changes much for the family. An uncontested application can go through a notary, under the non-contentious procedure. The notary meets with your loved one and files the application with the medical and psychosocial reports. Families often do not need to go to the courthouse. The court still makes the decision. If someone contests the application, a lawyer is usually involved and a hearing may be held.
Home visits off the island
Many homes in Hudson and Saint-Lazare are spread out, and getting a frail parent to an office is a real effort. I come to the home instead. I also see people in private seniors' residences (RPAs), CHSLDs and hospitals.
The visit usually takes 45 to 90 minutes. I spend part of it alone with your loved one and part with family. I am based in Dollard-des-Ormeaux, right next door to Vaudreuil-Soulanges.
Working with a notary
You can work with any notary in Quebec who handles homologation or tutorship files, including one in Montreal. For families who do not already have a notary, I work with Eric Dugas of Dugas & Dugas in Sainte-Geneviève, and I can suggest others.
Public or private, and what it costs
In the public network, a psychosocial assessment may be available at no charge. Your CLSC or your loved one's care team can explain how to access it and the current wait. Wait times vary. Some families choose a private social worker instead.
With a notary and a private psychosocial assessment, an uncontested homologation usually costs $3,000 to $7,000 in total. I give you a written estimate of my fees before we start. After the visit, my report is usually ready within two to four weeks.
